청구인들이 주장하는 상속받은 부동산의 임대보증금과 청구인들이 변제하였다고 주장하는 금액을 피상속인의 채무로 인정할 수 있는지 여부 (기각)

1. 처분개요청구인 OOO·OOO·OOO(이하 “청구인들”이라 한다)은 청구인들의 母인 청구외 OOO이 91.7.15 사망함에 따라 상속이 개시되어 92.1.11 상속재산가액을 315,729,500원으로 하여 신고한 사실이 있다.처분청은 청구인들에 대한 상속재산을 조사하여 상속세 과세표준을 506,318,072원으로 계산하고, 96.12.16 청구인들에게 91년도 상속세 193,628,920원을 결정고지하였다.청구인들은 이에 불복하여 97.2.13 심사청구를 거쳐 97.6.23 이 건 심판청구를 하였다.

2. 청구인들 주장 및 국세청장 의견가. 청구인들 주장(1) 상속개시전 2년내에 피상속인 위 OOO이 처분한 서울특별시 OO구 OO동 OOOOOO 대지 420.3㎡외 2필지 및 주택1동에 대한 부동산의 처분가액 632,944,008원에 대한 사용처로 522,456,250원이 확인되고 있음에도 이를 인정하지 않고 과세함은 부당하다.

(2) 피상속인이 생전에 임대한 부동산의 임대보증금 110,000,000원과 피상속인의 사채중 상속인들이 부담한 67,000,000원을 피상속인의 채무로 인정하여 상속재산가액에서 공제하여야 한다.

나. 국세청장 의견(1) 청구인들이 상속개시전 2년이내에 피상속인이 처분한 부동산의 대금 사용처로 제시하는 90.10.12 OO은행 OO지점에 입금한 1억원은 쟁점부동산의 양도대금으로 입금하였다는 객관적인 입증자료의 제시가 없고,90.4.9 OOOO보험(주)에 입금하였다는 200,000,000원은 그 입금자가 청구외 (주)OO실업으로 되어 있고, 청구외 (주)OO실업은 피상속인이 차입하여 지출한 금액이라고 하고 있으나 이 금액 또한 쟁점부동산의 양도대금으로 불입하였는지의 여부가 불분명하며,청구외 OOO외 3인에게 지급하였다는 채무상환금 역시 어떤 채무상환금이고, 위 부동산의 양도대금인지의 여부가 불분명하고, 청구인들이 이에 대한 구체적인 입증자료의 제시는 없어 위 부동산의 양도대금으로 입금된 것인지가 불분명하다.

(2) 청구인들은 상속재산가액에서 공제할 피상속인의 채무로 피상속인이 생전에 임대한 임대보증금 71,000,000원(110,000,000원에서 39,000,000원 기공제함)과 청구인들이 청구외 OOO외 3인에게 91.7.26 부터 91.12.13 까지 대신 지급한 피상속인의 채무로 67,000,000원을 인정하여야 한다면서 임대차계약서 사본과 무통장 입금증을 제시하고 있는 바,청구인이 임대보증금으로 제시한 임대차계약서 사본만으로는 신빙성이 없어 피상속인이 부담하여야 할 상속개시일 현재 채무로 보기는 어렵고,또한, 청구인들이 청구외 OOO외 3인에게 피상속인의 채무로 대신 지급하였다는 무통장 입금증 역시 피상속인이 부담하여야 할 채무인지의 여부가 불분명하다.

3. 심리 및 판단이 건 심판청구는 다음과 같은 쟁점이 있다.쟁점1, 청구인들이 제시한 522,456,250원을 상속개시전 2년내 피상속인이 처분한 부동산의 처분가액 632,944,008원의 사용처로 인정할 수 있는지 여부쟁점2, 청구인들이 주장하는 상속받은 부동산의 임대보증금 110,000,000원과 청구인들이 변제하였다고 주장하는 67,000,000원을 피상속인의 채무로 인정할 수 있는지 여부가. 쟁점(1)에 대하여(1)상속세법 제7조의 2제1항에서 「상속개시일전 2년이내에 피상속인이 상속재산을 처분한 경우 그 금액이 재산종류별로 계산하여 1억원이상으로서 용도가 객관적으로 명백하지 아니한 것중 대통령령이 정하는 경우에는 이를 제4조의 과세가액에 산입한다.」고 규정하고 있으며,같은 법 시행령 제3조 제1항에서 「법 제7조의 2 제1항 및 제2항에서 “대통령령이 정하는 경우”라 함은 다음의 경우를 말한다.

1. 피상속인이 재산을 처분하거나 채무를 부담하고 받은 금전등을 지출한 거래상대방(이하 “거래상대방”이라 한다)이 거래증빙의 불비등으로 확인되지 아니한 경우2. 거래상대방이 금전등의 수수사실을 부인하거나 거래상대방의 재산상태등으로 보아 금전등의 수수사실이 인정되지 아니한 경우3. 거래상대방이 피상속인과 특수관계에 있는 자로서 사회통념상 지출사실이 인정되지 아니한 경우4. 피상속인이 재산을 처분하거나 채무를 부담하고 받은 금전등으로 취득한 다른재산이 확인되지 아니한 경우5. 피상속인의 성별·연령·직업·경력·소득 및 재산상태 등으로 보아 지출사실이 인정되지 아니한 경우」라고 규정하고 있다.

(2) 피상속인이 상속개시전 2년내에 처분한 서울특별시 OO구 OO동 OOOOOO등 대지 3필지 723㎡ 및 주택 59.5㎡의 평가액이 632,944,008원인 사실에는 청구인들과 처분간에 다툼이 없다.

(3) 처분청이 사용처가 확인되는 것으로 인정한 금액은 위 부동산중 2필지의 양도에 따른 양도소득세 및 주민세 100,886,250원, 청구외 OOO에게 상환한 사채 30,000,000원, 전세금반환 30,000,000원으로서 합계액이 160,886,250원으로 위 부동산 평가액의 25.4%임이 상속세결정결의서등에 의하여 확인된다.

font-style:"normal"; color:#000000;'> <span> </span> </p> </td> </tr></table>(가) OO은행 OO지점에 피상속인의 명의로 예금된 100,000,000원이 위 부동산의 매도대금인지에 대한 자료의 제시가 없다.(나) OOOO보험(주)의 대출금은 OO실업(주)의 명의로 대출되었으며, 피상속인이 위 부동산의 매도대금으로 위 대출금을 상환하였다는 객관적인 입증자료의 제시가 없다.(다) 청구외 OOO외 3인에 대한 채무액 61,570,000은 피상속인 OOO이 OOO외 3인에게 무통장입금한 사실은 무통장입금표에 의하여 확인되나, 동 금액이 위 부동산을 처분한 금원에서 지급되었는지에 대한 입증자료의 제시가 없다.따라서, 청구인들이 사용처로 주장하는 522,456,250원중 그 사용처가 확인되는 것으로 처분청이 인정한 160,886,250원을 제외한 금액에 대하여는 객관적인 증빙의 제시가 없어 이를 인정하기 어렵다.

나. 쟁점(2)에 대하여(1)상속세법 제4조제1항에서 「제2조 제1항의 규정에 해당하는 경우에는 상속세를 부과할 상속재산가액에 상속개시전 5년이내에 피상속인이 상속인에게 증여한 재산의 가액과 상속개시전 3년이내에 피상속인이 상속인이외의 자에게 증여한 재산의 가액을 가산한 금액에서 다음 각호의 금액을 공제한 금액을 상속세과세가액으로 한다.

1. 공과금2. 피상속인의 장례비용3. 채무」라고 규정하고 있다.

다. 결론따라서 이 건 심판청구는 청구인의 주장이 이유없다고 인정되므로국세기본법 제81조및 제65조 제1항 제2호의 규정에 의하여 주문과 같이 결정한다.
