기간 경과한 심판청구는 부적합함(각하)

본안심리에 앞서 이 건 심판청구가 적법한 청구인지에 대하여 본다.

1. 지방세법 제74조 제3항, 지방세법 제77조 제5항, 국세기본법 제65조 및 국세기본법 제81조 를 보면, 지방세법에 의한 처분(신고납부 또는 수정신고납부를 한 경우에는 그 신고납부를 한 때에 처분이 있었던 것으로 본다)으로서 위법 또는 부당한 처분을 받았거나 필요한 처분을 받지 못함으로써 권리 또는 이익의 침해를 당한 자가 조세심판원장에게 심판청구를 하려는 때에는 당해 처분이 있은 것을 안 날(처분의 통지를 받은 때에는 그 통지를 받은 날)부터 90일 이내에 조세심판원장에게 심판청구를 하여야 한다고 규정하고 있고, 동 청구기간을 경과하여 심판청구를 한 때에는 그 청구를 각하하는 결정을 한다고 규정하고 있다.

2. 그런데, 처분청은 이 건 재산세 등의 고지서를 청구인에게 송달한 사실을 입증하는 자료를 제시하지 않고 있으나, 처분청의 2005년 ～ 2007년 부과현황 전산자료에 의하면, 처분청이 재산세 등의 고지서를 아래와 같이 부과고지하고, 청구인은 이를 납부한 사실을 알 수 있다. <재산세 등 부과고지 및 납부 내역> <table border="1" cellpadding="0" cellspacing="0"> <tr> <td height="27" valign="middle" width="90"> <p class='style-name:"바탕글";
