margin-bottom:0.0pt; text-align:justify; text-indent:0.0pt; line-height:160%; font-size:10.0pt; font-family:새굴림; letter-spacing:0.0pt; font-weight:"normal"; font-style:"normal"; color:#000000;'> <span> 6521.11 </span> </p> </td> </tr></table>청구법인은 건물 신축기간 중 부가가치세 매입세액을 전액 환급받았고, 건물이 완공되어 사업에 공하여진 2000년 1기 부가가치세 확정신고시 면세사업관련 매입세액을 안분계산하면서 부가가치세법 시행령 제61조 제1항의 공급가액비율을 적용하여 신고하였다가 2000.12.18 처분청에 2000년 1기 면세사업분에 대한 부가가치세 매입세액 안분계산에 대하여 부가가치세법 시행령 제61조 제4항 제3호의 규정에 의한 예정사용면적비율을 적용하여 달라는 부가가치세 경정청구를 하였다.

처분청은 청구법인이 2000.12.18 부가가치세 경정청구를 한데 대하여 2001.2.5 이를 거부하였다. 청구법인은 이에 불복하여 2001.5.7 심판청구를 제기하였다.

2. 청구법인 주장 및 처분청 의견 가. 청구법인 주장 부가가치세법 시행령 제61조 제1항에 의하면 과세사업과 면세사업을 겸업하는 사업자의 공통매입세액은 실지귀속별로 구분이 가능한 경우 실지귀속에 따라 안분계산하도록 하고 있고, 같은조 제4항에 의하면 건물을 신축 또는 취득하여 과세사업과 면세사업에 제공할 예정면적을 구분할 수 있는 경우에는 예정사용면적의 비율로 안분계산하도록 하고 있으므로 처분청이 경정청구를 거부한 것은 부당하다.

나. 처분청 의견 청구법인이 신축한 건물은 대형할인매장으로서 할인매장의 특성상 과세품목과 면세품목이 혼재되어 있으며, 과세품목과 면세품목의 판매장이 구분되어 있더라도 판매상황에 따라 위치나 면적을 변경할 수 있는 것으로 사업별 매장의 면적이 불분명하여 공급가액비율을 적용하여 공통매입세액을 안분계산한 것은 정당하다.

3. 쟁점 및 판단 가. 쟁점 과세사업과 면세사업을 겸업하는 청구법인의 매장건물 신축시 발생한 공통매입세액을 과세 및 면세재화의 공급가액비율로 안분계산할 수 있는지 여부 나. 관련법령 이건 관련법령은 다음과 같다. 부가가치세법 제12조 【면 세】① 다음 각호의 재화 또는 용역의 공급에 대하여는 부가가치세를 면제한다.

1. 가공되지 아니한 식료품(식용에 공하는 농산물·축산물·수산물과 임산물을 포함한다) 및 우리 나라에서 생산된 식용에 공하지 아니하는 농산물·축산물·수산물과 임산물로서 대통령령이 정하는 것 같은법 제17조 【납부세액】 ②다음 각호의 매입세액은 매출세액에서 공제하지 아니한다.

4. 부가가치세가 면제되는 재화 또는 용역을 공급하는 사업에 관련된 매입세액(투자에 관련된 매입세액을 포함한다)과 대통령령이 정하는 토지관련매입세액 같은법 시행령 제61조 【매입세액의 안분계산】 ①사업자가 과세사업과 면세사업을 겸영하는 경우에 면세사업에 관련된 매입세액의 계산은 실지 귀속에 따라 하되, 과세사업과 면세사업에 공통으로 사용되어 실지 귀속을 구분할 수 없는 매입세액(이하 "공통매입세액"이라 한다)은 다음 산식에 의하여 계산한다.

다만, 예정신고를 하는 때에는 예정신고기간에 있어서 총공급가액에 대한 면세공급가액의 비율에 의하여 안분계산하고, 확정신고를 하는 때에 정산한다. 면세사업에 관련된 매입세액= 공통매입세액 × 면세공급가액 / 총공급가액 ④제1항의 규정을 적용함에 있어서 당해 과세기간중 과세사업과 면세사업의 공급가액이 없거나 그 어느 한 사업의 공급가액이 없는 경우에 당해 과세기간에 있어서의 안분계산은 다음 각호의 순에 의한다. 다만, 건물을 신축 또는 취득하여 과세사업과 면세사업에 제공할 예정면적을 구분할 수 있는 경우에는 제3호를 제1호 및 제2호에 우선하여 적용한다.

1. 총매입가액(공통매입가액을 제외한다)에 대한 면세사업에 관련된 매입가액의 비율 2. 총예정공급가액에 대한 면세사업에 관련된 예정공급가액의 비율 3. 총예정사용면적에 대한 면세사업에 관련된 예정사용면적의 비율 같은법 시행령 제61조의 2 【공통매입세액의 정산】사업자가 제61조제4항의 규정에 의하여 매입세액을 안분계산한 경우에는 당해 재화의 취득으로 과세사업과 면세사업의 공급가액 또는 과세사업과 면세사업의 사용면적이 확정되는 과세기간에 대한 납부세액을 확정신고하는 때에 다음 각호의 산식에 의하여 정산한다.

다만, 예정신고를 하는 때에는 예정신고기간에 있어서 총공급가액에 대한 면세공급가액의 비율 또는 총사용면적에 대한 면세사용면적의 비율에 의하여 안분계산하고, 확정신고하는 때에 정산한다.

2. 제61조제4항제3호의 규정에 의하여 매입세액을 안분계산한 경우 가산 또는 공제되는 세액 = (총공통매입세액 ×〔1 - 과세사업과 면세사업의 사용면적이 확정되는 과세기간의 면세사용면적 / 과세사업과 면세사업의 사용면적이 확정되는 과세기간의 총사용면적〕- 기공제세액) 다. 사실관계 및 판단 (1) 청구법인은 청구외 OO건설주식회사 등으로부터 매장건물 신축공사용역을 공급받아 2000.4.22 OO시장의 사용승인을 받았고, 2000.5.26 소유권보존등기하였음이 건물등기부등본 등 관련자료에 의하여 확인된다.

(2) 청구법인은 공사기간중 아래와 같이 부가가치세 신고하여 매입세액을 공제받았음이 부가가치세신고서에 의하여 확인된다. (5) 처분청은 청구법인의 2000.12.18 경정청구에 대하여 청구법인이 2000년 1기에 공급가액이 있고, 매장 특성상 과세사업에 공하는 면적과 면세사업에 공하는 면적이 일시적으로만 구분되므로 부가가치세법 시행령 제61조 제4항 제3호를 적용할 요건에 해당하지 아니한다고 보아 경정청구를 기각하였음이 「경정청구에 대한 검토결과 통지(2001.2.5)」에 의하여 확인된다.

(6) 위 관련법령과 사실관계를 종합해보면 부가가치세법 시행령 제61조 제4항 단서규정에서 건물신축의 경우 예정사용면적비율을 우선 적용하도록 하고 있고, 건물 신축과 관련된 매입세액에 있어서 면세사업에 사용되는 면적과 과세사업에 공하는 면적은 실지 귀속분을 찾을 수 있는 가장 적합한 판단기준으로 볼 수 있으며 건물 신축관련 매입세액은 특단의 사정이 없는 한 그 건축비용이 건물의 면적에 비례하여 발생되는 것으로 볼 수 있으므로 과세사업과 면세사업을 함께 영위할 목적으로 신축한 건물에 있어서 과세사업에 공하는 면적과 면세사업에 공하는 면적이 구분되어 있는 경우 건물 신축관련 매입세액은 과세 및 면세에 공하고 있는 면적의 비율에 의하여 합리적으로 계산할 수 있다 할 것이고(국심99광1277, 1999.10.8. 외 다수 같은뜻), 부가가치세가 과세되는 재화와 면세되는 재화를 판매하는 할인매장의 가맹점인 청구법인의 경우 실제 과세사업에 공하는 면적과 면세사업에 공하는 면적의 실측을 통하여 사용면적을 구분할 수 있는 것으로 보여지므로(국심99부0341, 1999.8.14. 같은뜻) 건물신축과 관련된 매입세액을 과세사업과 면세사업에 제공하는 면적을 기준으로 안분계산해 달라는 청구법인의 경정청구를 처분청이 거부한 것은 부당하다고 판단된다.

라. 따라서 이 건 심판청구는 청구주장이 이유있으므로 국세기본법 제81조 및 제65조 제1항 제3호의 규정에 의하여 주문과 같이 결정한다.

청구법인의 2000년 1기 부가가치세 과세표준과 세액은 청구법인이 2000.12.18 청구한 경정청구 내용에 따라 건물신축 관련 매입세액과 면세사업에 공하고 있는 사업장면적을 조사하여 부가가치세법 시행령 제61조 제4항 제3호의 규정에 의하여 이를 경정한다.
