Q: 건축물에 대한 재산세 부과처분이 적법한지 여부

재산세는 보유하는 재산에 담세력을 인정하여 부과하는 조세로서 재산세액을 그 과세표준으로 하고 있어 그 본질은 재산소유 자체를 과세요건으로 하는 것이고(대법원 2001.4.24. 선고 99두110 판결), 재산세는 납세자 개개인의 특수한 사정을 모두 고려하는 것이 원칙적으로 불가능하여 합리적인 평가요소인 시가표준액이 객관적인 재산가치를 반영하고 있다고 보아 이를 기준으로 재산세를 부과하는 것임.

이유

1. 처분 개요 가. 청구인이 2012년도 재산세 과세기준일(6.1.) 현재 소유가 있는 OOO소재한 지상 4층의 건축물{연면적824.7㎡, 1층 근린생활시설 214.05㎡, 2～4층 독서실 526.12㎡, 4층 주택 84.53㎡, 이하 “쟁점건축물”이라 한다}에 대하여 처분청은 201.7.25. 2012년도 정기분 재산세를 부과하면서 주택을 제외한 일반건축물의 과세표준액을 OOO하여 재산세 OOO지역자원시설세 OOO지방교육세 OOO합계 OOO원을 결정·고지하였다.

나. 청구인은 이에 불복하여 2012.7.25. 심판청구를 제기하였다.

2. 청구인 주장 및 처분청 의견 가. 청구인 주장 쟁점건축물은 주변 환경이 매우 낙후된 지역에 위치하여 상가 및 주거시설의 가치가 상실된 상태임에도 이를 고려하지 아니하고 재산세를 과다하게 부과한 것은 부당하다.

나. 처분청 의견 쟁점건축물이 소재한 OOO주택단지의 도로변 모서리에 위치하고 있으며, 도로 건너편에 유명 중·고등학교가 있고 인근에 대단지 재개발 아파트가 신축 중에 있으며, 개별공시지가가 2012년도에 2011년 대비 11%상승(OOO원)한 것을 보더라도 청구인의 주장은 근거가 없으며, 시가표준액에 부동산시장의 동향과 지방재정 여건을 고려한 공정시장가액비율을 적용하여 산출된 과세표준을 근거로 이 건 재산세 등을 부과한 처분은 적법하다.

3. 심리 및 판단 가. 쟁 점 주상복합건축물의 주변환경이 낙후되어 재산가치가 하락하였음에도 이를 고려하지 아니하고 재산세를 부과한 처분이 부당하다는 청구주장의 당부 나. 관련 법령 (1) 지 방세법 제4조【부동산 등의 시가표준액】① 이 법에서 적용하는 토지 및 주택에 대한 시가표준액은 「부동산 가격공시 및 감정평가에 관한 법률」에 따라 공시된 가액(價額)으로 한다. 다만, 개별공시지가 또는 개별주택가격이 공시되지 아니한 경우에는 시장ㆍ군수 또는 구청장(자치구의 구청장을 말한다.

이하 “시장ㆍ군수”라 한다)이 같은 법에 따라 국토해양부장관이 제공한 토지가격비준표 또는 주택가격비준표를 사용하여 산정한 가액으로 하고, 공동주택가격이 공시되지 아니한 경우에는 대통령령으로 정하는 기준에 따라 시장ㆍ군수가 산정한 가액으로 한다. ② 제1항 외의 건축물(새로 건축하여 건축 당시 개별주택가격 또는 공동주택가격이 공시되지 아니한 주택으로서 토지부분을 제외한 건축물을 포함한다), 선박, 항공기 및 그 밖의 과세대상에 대한 시가표준액은 거래가격, 수입가격, 신축ㆍ건조ㆍ제조가격 등을 고려하여 정한 기준가격에 종류, 구조, 용도, 경과연수 등 과세대상별 특성을 고려하여 대통령령으로 정하는 기준에 따라 지방자치단체의 장이 결정한 가액으로 한다.

제110조【과세표준】① 토지ㆍ건축물ㆍ주택에 대한 재산세의 과세표준은 제4조제1항 및 제2항에 따른 시가표준액에 부동산 시장의 동향과 지방재정 여건 등을 고려하여 다음 각 호의 어느 하나에서 정한 범위에서 대통령령으로 정하는 공정시장가액비율을 곱하여 산정한 가액으로 한다.

1. 토지 및 건축물: 시가표준액의 100분의 50부터 100분의 90까지 2. 주택: 시가표준액의 100분의 40부터 100분의 80까지 (2) 지방세법 시행령 제4조【건축물 등의 시가표준액 결정 등】① 법 제4조제2항에서 "대통령령으로 정하는 기준"이란 과세대상별 구체적 특성을 고려하여 다음 각 호의 방식에 따라 행정안전부장관이 정하는 기준을 말한다.

font-style:"normal"; color:#000000;'> 84.53 </td> </tr></table>(2) 처분청이 쟁점건축물 중 주택을 제외한 건축물에 대하여 시가표준액 산정한 내역을 보면, 2012년도 건물신축가격기준액(OOO원)에 철골철근콘크리트구조지수(120), 근린생활시설 및 체육시설 용도지수(125), 2012년도 부속토지의 개별공시지가 OOO/㎡에 해당하는 위치지수(90)과 잔가율(0.8720)을 각각 곱하여 산정한 ㎡당 가액 OOO기준으로 건물면적과 공정시장가격비율(70%)을 곱하여 쟁점건축물의 시가표준액을 OOO원으로 산정한 것으로 나타난다(경량철골조 부분은 과세하지 아니함). (3) 처분청이 제시한 쟁점건축물의 현황에 대한 인터넷지도(다음)에는 쟁점건축물이 도로변에 위치하여 있고, 맞은 편에 중고등학교가 있으며, 주위에는 주택들이 소재하고 있는 것으로 나타난다.

(4) 이에 대하여 청구인은 쟁점건축물의 주변환경이 낙후되어 상가 및 주택으로서의 가치가 상실된 상태이므로 이 건 부과처분이 부당하다고 주장하나, (가) 쟁점건축물의 경우 2011년에 비하여 재산세가 변동된 사유는 재산세 과세표준의 산정기준이 되는 시가표준액을 산정하면서 신축건물가격이 2011년에는 OOO이었다가 2012년에는 OOO원으로 상승하였고, 쟁점건축물 부속토지의 가격이 2011년에는 OOO이었다가 2012년에는 OOO으로 상승하였으므로 이에 따라 위치지수가 상향조정됨에 따라 재산세가 상승한 것이며, (나) 시가표준액은 지방세법상의 근거에 따라 처분청이 고시한 시가표준액 산정기준에 따라 산정되는 것으로서 쟁점건축물에 대하여 시가표준액 산정에 있어서 잘못 적용된 부분이 확인되지 아니하고, 쟁점건축물이 2004.2.23. 신축된 건축물로서 신축연도가 오래되지 아니하였고 주변환경이 낙후되었음에도 시가표준액이 과다하게 산정되었다고 볼 수 있는 합리적인 근거가 없으므로 이 건 재산세 부과처분이 부당하다는 청구인의 주장은 받아들이기 어렵다고 판단된다.

4. 결 론 이 건 심판청구는 심리결과 청구주장이 이유없으므로 「지방세법」제123조 제4항과 「국세기본법」제81조 및 제65조 제1항 제2호에 의하여 주문과 같이 결정한다.
