가공세금계산서인지 여부(기각)

1. 사실 청구인은 화물운송업을 영위하는 자로서 1999년중 청구외 OO에너지(주)로부터 6건 42,597,455원, OO주유소로부터 4건 12,003,365원, (주)OO석유 OO주유소로부터 4건 22,501,506원 합계 14건 77,102,326원(이하 “쟁점매입금액”이라 한다)의 매입세금계산서를 교부받아 부가가치세 신고시 매입세액을 공제받고, 종합소득세신고시 필요경비에 산입하였다. 처분청은 청구인이 청구외 OO에너지(주)로부터 교부받은 매입세금계산서 3건의 공급가액 40,001,819원(이하 “쟁점1매입금액”이라 한다)을 필요경비부인하여 2001.1.2. 청구인에게 종합소득세 8,979,030원을 경정고지 하였고, 2001.3.2. 청구인이 잘못 적용한 중소제조업등에대한특별세액감면을 배제하여 2,766,890원을 재경정고지하였으며, 2001.4.2. 청구인이 OO에너지(주)로부터 교부받은 매입세금계산서 3건의 공급가액 2,595,636원, OO주유소로부터 교부받은 매입세금계산서 4건의 공급가액 12,003,365원, (주)OO석유 OO주유소로부터 교부받은 매입세금계산서 4건의 공급가액 22,501,506원 합계 11건 37,099,000원(이하 “쟁점2매입금액”이라 한다)을 필요경비부인하여 청구인에게 종합소득세 14,190,708원을 경정고지하였다.

청구인 주장 쟁점매입금액은 실제 유류를 매입한 금액이나 세금계산서를 교부받지 아니하고 금전등록기 영수증을 교부받음으로써 매입세액을 공제받을 수 없어 다른 거래처로부터 위장세금계산서를 교부받은 것이므로 쟁점매입금액은 필요경비에 산입되어야 한다.

나. 처분청 의견 처분청은 과세처분전에 청구인이 쟁점매입금액의 유류를 실제 매입하였는지 여부에 대하여 소명을 요구하였으나 청구인은 이에 응하지 아니하였고, 이 건 심판청구시 청구인이 제출한 금전등록기 영수증은 매출처인 거래상대방에 의해 그 거래여부가 확인되지 아니하므로 쟁점매입금액은 필요경비에 산입할 수 없다.

3. 쟁점 및 판단 가. 쟁점 청구인이 쟁점매입금액의 유류를 실제 매입하였는지 여부를 가리는 데 있다.

나. 관련법령 소득세법 제27조 【필요경비의 계산】 ① 부동산임대소득·사업소득금액·일시재산소득금액·기타소득금액 또는 산림소득금액의 계산에 있어서 필요경비에 산입할 금액은 당해 연도의 총수입금액에 대응하는 비용으로서 일반적으로 용인되는 통상적인 것의 합계액으로 한다. ② (생략) 같은법시행령 제55조 【부동산임대소득등의 필요경비의 계산】 ①부동산임대소득과 사업소득의 각 연도의 총수입금액에 대응하는 필요경비는 다음 각호의 것으로 한다 1. 판매한 상품 또는 제품에 대한 원료의 매입가격(매입에누리 및 매입할인금액을 제외한다)과 그 부대비용.

이 경우 사업용외의 목적으로 매입한 것을 사업용으로 사용한 것에 대하여는 당해 사업자가 당초에 매입한 때의 매입가액과 그 부대비용으로 한다. ② (생략) 같은법 제80조 【결정과 경정】 ①(생략) ② 납세지 관할세무서장 또는 지방국세청장은 제70조 내지 제72조 또는 제74조의 규정에 의한 과세표준확정신고를 한 자가 다음 각호의 1에 해당하는 경우에는 당해 연도의 과세표준과 세액을 경정한다.

1. 신고내용에 오류 또는 탈루가 있는 때 2.～ 3. (생략) ③납세지 관할세무서장 또는 지방국세청장은 제1항 및 제2항의 규정에 의하여 당해 연도의 과세표준과 세액을 결정 또는 경정하는 경우에는 장부 기타 증빙서류를 근거로 하여야 한다.(단서 생략) 부가가치세법 제32조의2 (신용카드등의 사용에 따른 세액공제등) ①·② (생략) ③일반과세자가 신용카드매출전표등에 공급받는 자와 부가가치세액을 별도로 기재하고 확인한 때에는 그 부가가치세액은 제17조제1항 및 제26조제3항의 규정에 의하여 공제받을 수 있는 매입세액으로 본다.

다. 사실관계 및 판단 (1) OO세무서장은 2000.4.27. 청구외 OO에너지(주) 및 OO석유(주)를 자료상으로 확정하여 청구외 OO에너지(주)는 OO지방검찰청에, 청구외 OO석유(주)는 OO지방검찰청에 고발하고, 처분청에 관련 과세자료를 통보하였으며, OO세무서장은 1999.12.6. OO주유소를 자료상으로 확정하여 OO지방검찰청 OO지청에 고발하고 관련 과세자료를 처분청에 통보하였다. 이에 따라 처분청은 청구인에게 쟁점1매입금액에 대하여 2000.12.12.에, 쟁점2매입금액에 대하여는 2001.2.13.에 소명안내서를 발송하였으나 청구인은 이에 대하여 해명하지 못하였으며, 이러한 사실은 OO세무서장 및 OO세무서장에게 발송한 공문과 처분청이 청구인에 발송한 소명자료안내문등에 의해 확인된다.

font-style:"normal"; color:#000000;'> <span> 86,100,000 </span> </p> </td> </tr></table>청구인은 1999년중 청구외 OO에너지(주)외 2인의 자료상으로부터 실물거래없이 쟁점매입금액의 가공세금계산서를 교부받은 사실이 확인되었고, 이에 대한 처분청의 과세처분전 소명요구에 해명하지 못하였으며, 청구인이 이 건 심판청구시 제출한 금전등록기영수증상의 거래내역은 거래상대방 및 대금결제내역등에 의해 그 사실여부가 확인되지 아니하므로 쟁점매입금액을 필요경비에 산입하여야 한다고 하는 청구인의 주장은 받아들이기 어렵다고 판단된다.

라. 결론 이 건 심판청구는 청구주장이 이유 없으므로 국세기본법 제65조 제1항 제2호 및 제81조 규정에 의하여 주문과 같이 결정한다.
