이유

1. 원처분 개요청구인은 서울특별시 송파구 OO동 OOOOO등 4필지 대지 886.7㎡를 별첨과 같이 87.5.7～89.5.20 기간에 취득하여 동지상에 87.8.24～90.1.31 기간에 주택 및 상가건물 2,113.57㎡(위토지 및 건물을 이하 “쟁점부동산”이라 한다)를 신축하여 1～9개월간 소유 또는 임대하다가 양도하고 각각 양도차익 예정신고를 이행하였다.처분청은 92.5월 쟁점부동산의 양도에 대한 세무조사과정에서 청구인이 86～90년 사이에 6회에 걸쳐 주택 및 상가건물을 계속적·반복적으로 신축하여 양도한 사실이 확인되므로 이는 부동산매매업에 해당된다고 보아 소득세과세표준을 확인된 실지양도가액에 소득표준율(24.7%)을 적용하여 92.6.16 청구인에게 별지 종합소득세 232,678,630원 및 동 방위세 46,775,710원을 결정고지하였다.청구인은 이에 불복하여 92.6.30 이의신청과 92.8.20 심사청구를 거쳐 92.10.20 심판청구를 제기하였다.

2. 청구주장 및 국세청장 의견가. 청구주장청구인은 92.4.4 당초 조사관서인 서울지방국세청으로부터 토지취득 및 건물신축에 따른 증빙서류를 92.4.7까지 이 건 조사관서에 제출하라는 통보를 받고 92.4.12 당초 조사관서인 서울지방국세청에 제출하였는데 처분청은 이에 대하여 사실여부도 확인하지 아니한 채 동 자료를 부인하고 실지양도가액에 소득표준율을 적용하여 추계조사결정함은 부당하므로 실지조사결정에 의하여야 한다는 주장이다.

나. 국세청장 의견국세청장은 청구인이 토지의 취득가액을 높게 기장한 점, 미등록 사업자인점 및 양도소득세를 신고하고 부동산매매업에 대한 종합소득세를 무신고한 점등으로 미루어 보아 청구인의 장부기장내용은 신뢰할 수 없으므로 소득금액을 추계조사결정한 당초처분은 잘못이 없다는 의견이다.

3. 심리 및 판단가. 쟁점청구인이 비치·기장하고 있는 장부의 기장내용을 정당한 기장으로 보지 아니하고 종합소득세 추계조사결정한 당초처분의 당부를 가리는데 있다.

나. 관련법령소득세법 제118조제4항에 의하면 기장의무자 이외의 거주자에 대하여 비치·기장된 장부 또는 기타의 장부와 증빙서류를 근거로 하여 소득금액을 계산할 수 있을 때에는 그 비치·기장된 장부에 의하여 당해년도의 과세표준과 세액을 실지조사 결정하도록 규정하고 있고,같은법 제120조및같은법 시행령 제169조제1항 제1호를 보면 정부는 과세표준을 계산함에 있어서 필요한 장부와 증빙서류가 없거나 중요한 부분이 미비 또는 허위인 때 등의 사유로 실지조사결정등에 의하여 결정할 수 없는 때에 한하여 과세표준과 세액을 업종별 소득표준율에 의하여 추계조사결정한다라고 규정하고 있으며,같은법 제94조제1항에서 부동산매매업자가 토지등 매매차익예정신고를 하지 아니한 때에는 정부는 즉시 그 매매차익 또는 세액을 결정하거나 경정하고 대통령령이 정하는 바에 의하여 당해 부동산매매업자에게 통지하여야 한다고 규정하고 있으며,같은법 시행령 제142조제1항에 의하면 법 제94조의 규정에 의한 토지등 매매차익과 세액의 결정은 다음 각호에 의한다라고 규정하면서 제1호에서 부동산매매업자가 매매차익예정신고시 제출한 증빙서류 또는 비치·기장한 장부와 증빙서류에 의하여 제141조의 규정에 의한 토지등 매매차익을 계산할 수 있을 때에는 그에 의하여 조사·결정한다라고 규정하고 있고, 제2호에서는 제169조 제1항 각호에 해당하는 경우에는 토지등 매매차익은 제141조의 규정에 불구하고 매매가액에 소득표준율을 곱하여 계산한 금액으로 한다고 규정하고 있으며, 또한 같은조 제2항에 의하면 제1항 제2호에서 매매한 토지등의 실지거래가액을 확인할 수 있는 경우에는 실지거래가액을 매매가액으로 하고, 실지거래가액을 확인할 수 없는 경우에는 제115조에 규정한 기준시가를 매매가액으로 한다고 규정하고 있다.위 규정에서 장부의 비치·기장의 요건은 장부의 기재사항에 의하여 법에 규정하는 총수입금액, 소득금액 및 과세표준의 계산이 가능하고, 매매거래의 경우 기록을 거래별로 기록하지 아니하고 세금계산서, 계산서 또는 이에 준하는 영수증, 지불증을 주의깊게 철하여 이에 의하여 일계나 주계 또는 월계로서 기록하여도 정당한 기장을 한 것으로 보고 있다(같은법 기본통칙 9-1-1...184 동지).다.

text-align:justify; text-indent:0.0pt; line-height:160%; font-size:10.0pt; font-family:새굴림; letter-spacing:0.0pt; font-weight:"normal"; font-style:"normal"; color:#000000;'> 181,005,110원 </td> </tr></table>첫째, 원시적 내용을 기재한 노트 및 공사원재료구입 관련영수증과 세금계산서등을 보면 청구인은 건축자재등 원재료비용을 쟁점부동산중 OOOOO 번지 신축시 18,221,170원, OOOOOO 번지 신축시 12,410,170원, OOOOOO 번지 신축시 20,100,000원 및 OOOO 번지 신축시 33,178,000원을 지출하였음이 확인되고 있고,둘째, 일용근로자 임금대장등을 보면 청구인은 근로자별로 임금대장을 작성하여 근로자의 성명, 주민등록번호, 주소 및 임금지급액등을 구체적으로 기재하고 있어 임금지급 대상자가 확인되고 또한, 그 내용이 위 표상의 쟁점부동산별 지급금액과 동일하므로 청구인이 제출한 동 임금지급대장은 신빙성이 있어 보이며셋째, 청구인이 제출한 출금전표를 보면 청구인은 일반경비를 쟁점부동산중 OOOOO번지 신축시 33,554,360원, OOOOOO번지 신축시 70,505,940원 및 OOOOOO번지 신축시 37,446,151원 및 OOOO번지 신축시 181,005,110원을 지급하였음이 확인되고 있으며,④ 청구인이 당초 조사관서인 서울지방국세청에 쟁점부동산의 실지취득가액관련 증빙자료를 제출한 경위 및 처분청의 처분내용을 보면 청구인은 92.4.4자로 서울지방국세청으로부터 쟁점토지 및 건물의 공사원가에 관한 증빙서류를 92.4.7까지 제출(92.3.30 일반우편물로 발송)하라는 요구서를 접수하고 92.4.12 위에서 살펴본 증빙자료를 제출하였으나 서울지방국세청은 제출기한일로부터 5일 경과하여 제출하였다는 이유로 동 증빙자료의 사실 여부에 대한 검증이나 실지조사없이 이를 무시하고 실지양도가액에 소득표준율을 적용하여 이 건을 과세한 사실이 92.8.4자로 청구인이 당초 조사관서에 제출한 「실지조사요구에 관한 진정서」 및 92.8.7 「서울지방국세청이 청구인에게 회신한 내용」에 의하여 확인되고 있는 바, 위 내용에 의하면 청구인은 당초 조사관서의 자료요구서를 접수하고 8일만에 원시장부 및 그 증빙자료를 제출한 것으로 보면 당초없던 증빙을 임의로 조작하여 제출하였다고 볼 수 없을 뿐만 아니라 설사 동증빙이 조작되어 그 내용이 신빙성이 없다 하더라도 처분청은 청구인이 제시하는 관련증빙자료를 실지조사 및 검증등의 절차를 거쳐 그 진위여부에 따라 추계조사결정 또는 실지조사결정을 하여야 함에도 동 절차를 거치지 아니하고 추계조사결정함은 당초 조사관서가 사실관계조사를 소홀히 하였다고 보여지며,⑤ 청구인이 88.9.23 서울특별시 송파구 OO동 OOOO 소재 대지 92.3㎡(이하 “쟁점외 부동산”이라 한다)를 취득하여 89.4.19 동 지상에 주택 및 상가건물 163.76㎡를 신축하여 89.4.29 양도한 건에 대하여 처분청이 91.3월 부동산매매업으로 보아 종합소득세를 과세하면서 그 과세표준을 실지조사결정한 사실이 쟁점외 부동산의 소득세과세표준금액 및 세액 결정결의서에 의하여 확인되고 있어 청구인은 쟁점외 부동산의 신축판매시에도 관련증빙을 비치·보관하여 왔음을 알 수 있다.위의 사실을 종합하여 볼 때, 쟁점부동산의 실지취득가액 및 실지양도가액을 관련장부와 증빙에 의하여 확인할 수 있는 경우에 해당된다고 보여지므로 쟁점부동산의 매매차익(과세표준)은소득세법 제118조및 제94조와같은법 시행령 제142조제1항의 규정에 의하여 실지조사하여 그 과세표준과 세액을 경정결정함이 타당하다고 판단된다.
