2. 청구주장 및 국세청장 의견 가. 청구인 주장 기준시가로 양도소득을 계산하면 각각 과세미달임에도 불구하고 실지거래가액으로 양도차익을 계산하고 과세함은 부당하다는 주장이다.

나. 국세청장 의견 부동산을 취득하여 1년이내 양도하였으므로 실지거래가액으로 양도차익을 계산하고 과세한 처분에 잘못이 없다는 의견이다.

3. 심리 및 판단 가. 쟁점 실지거래가액으로 양도차익을 계산하고 과세한 처분의 당부를 가리는 데 있다.

나. 관련법조 자산양도차익을 계산함에 있어서 기준이 되는 양도가액과 취득가액을 어떻게 결정할 것인가에 관하여 규정하고 있는 소득세법 제23조 제4항 및 동법 제45조 제1항 제1호를 살펴보면, 취득가액 및 양도가액은 기준시가로 결정함을 원칙으로 하되, 예외적으로 구소득세법시행령 제170조 제4항의 규정 및 동법시행규칙 제82조의2 제4항의 규정에 의하여 실지거래가액이 확인되는 경우 실지거래가액으로 양도차익을 계산토록 규정되어 있고 위 소득세법시행령 제170조 제4항은 제1호에서 국가·지방자치단체·기타 법인과의 거래에 있어서 양도 또는 취득당시의 실지거래가액이 확인된 경우, 제2호에서 국세청장이 지역에 따라 정하는 일정규모이상의 거래, 기타 부동산투기의 억제를 위하여 필요하다고 인정되어 국세청장이 지정하는 거래에 있어서 양도 또는 취득당시의 실지거래가액을 확인할 수 있는 경우, 제3호에서 양도자가 법 제95조 또는 법 제100조의 규정에 의한 신고시 제출한 증빙서류에 의하여 취득 및 양도당시의 실지거래가액을 확인할 수 있는 경우로 규정하고 있음을 알 수 있고, (위 소득세법시행령 제170조 제4항은 89.8.1 동 제1호가 삭제되고, 제2호에서 부동산을 취득한 후 1년이내에 양도한 경우 실지거래가액으로 과세할 수 있도록 명문화 하였음) 재산제세조사사무처리규정 제72조 제3항에서는 위 소득세법시행령 제170조 제4항 제2호의 거래를 양도 또는 취득당시의 실지거래가액이 확인된 경우로서 8개 항목을 열거하고 그중 「부동산을 취득하여 1년이내 양도한 때」실지거래가액으로 양도차익을 계산하고 과세할 수 있는 하나로 규정하고 있다.

다. 사실관계 청구인은 쟁점토지를 취득한 후 1년이내 단기양도하였고 취득 및 양도가액에는 다툼이 없다.

라. 위 관련법조와 사실관계를 종합하여 볼 때 처분청이 실지거래가액으로 양도차익을 계산하고 과세한 처분에 잘못이 없다. 따라서 이 건 심판청구는 청구주장이 이유없으므로 국세기본법 제81조 및 제65조 제1항 제2호의 규정에 의하여 주문과 같이 결정한다.
