2. 청구주장부동산등기부상으로 청구인이 이 건 부동산을 89.3.28 청구외 OOO에게 양도한 것으로 등기되어 있으나, 그 소유권이전은 청구외 OOO이 청구인의 인감도장을 임의로 사용하여 이 건 부동산의 소유권을 이전한 것이라고 주장하고 있다.그러므로 이 건 부동산의 소유권이전은 무효이고 그 무효인 소유권이전을 근거로 하여, 처분청이 과세한 이 건 처분은 취소하여야 한다는 주장이다.

3. 국세청장 의견소득세법 제4조제1항에 “거주자의 소득은 다음 각호와 같이 구분한다”고 규정하면서 그 제3호에 “자산의 양도로 인하여 발생하는 소득”을 양도소득으로 열거하고,같은법 제4조제3항에 “제1항 제3호에서 「양도」라 함은 자산에 대한 등기 또는 등록에 관계없이 매도·교환·법인에 대한 현물출자등으로 인하여 그 자산이 유상으로 사실상 이전되는 것을 말한다”고 되어있는 바, 이 건의 경우 “양도소득세 과세자료전 겸 결정결의서”를 보면 89.3.31자 이 건 부동산이 “매매”를 원인으로 OOO 명의로 소유권이전등기한 것으로 되어 있어 사실상 유상으로 이전되었다 할 것이므로(무상으로 이전되었다면 “증여를 원인으로 등기되었을 것임), 청구인 소유의 이 건 부동산이 OOO 명의로 소유권 이전등기된데 대하여, 앞에서 열거한 법령에 의거 양도소득세를 과세함은 잘못이 없다고 보여지고, 청구인은 위 OOO이 등기서류를 위조하여 등기한데 대하여 사문서 위조등으로 형사고소하고 소유권이전 등기말소 청구소송을 제기하였다고 주장하나, 이에 대한 증빙제시가 없고 설사 위 고소와 소송제기 사실이 틀림없다고 하더라도 동 소송사건이 청구주장대로 판결이 확정될 때까지는 이 건 부동산을 청구인이 위 OOO에게 양도한 사실이 없다는 주장은 받아들일 수 없다는 의견이다.

4. 쟁점이 건 부동산의 소유권이 매매를 원인으로 이전되었고, 청구인이 그 소유권이전은 무효라는 확실한 거증을 제시하지 못하는 경우, 그 소유권이전 사실에 대하여 양도소득세를 과세할 수 있는지 여부를 가리는데 있다 하겠다.

5. 심리 및 판단부동산등기부에 89.3.28 이 건 부동산의 소유권이 매매를 원인으로 청구외 OOO앞으로 이전된 사실에 대하여는 청구인과 처분청간에 다툼이 없고, “3. 국세청장 의견”에서 열거한소득세법 제4조제1항 및 제3항의 규정에 의하여 자산의 양도로 인하여 발생하는 소득은 양도소득세가 과세되는 것이다.그런데 청구인은 청구외 OOO이 청구인의 인감도장을 도용하여 임의로 이 건 부동산의 소유권을 이전한 것일뿐 실질적으로 이 건 부동산을 양도한 사실이 없다고 주장하고 있으나, 부동산등기부에 소유권이 이전되어 있으면 등기부상의 법률관계가 실체법상으로도 존재하는 것으로 추정되는 것이고, 청구외 OOO이 인감도장을 도용하여 소유권이전등기를 하였다는 명백한 거증이 없어서, 처분청이 이 건 부동산의 소유권이 매매를 원인으로 이전된 사실에 대하여 소득세법령상 양도로 보아 양도소득세 등을 부과한 당초 처분은 정당한 것으로 보여진다.그리고 이 건 부동산의 등기부상의 권리관계가 일응 진정한 것이 아니고 그 소유권이전자체가 무효라면, 그 입증책임은 이를 주장하는 자에게 있다 할 것인 바, 청구인은 청구외 OOO이 인감도장을 도용하여 이 건 부동산의 소유권을 임의로 이전한 사실에 대한 경위나 정황 또는 그 사실을 믿을 수 있는 어떤 거증자료도 제출하지 아니하고 있어서 청구인의 주장은 신빙성이 없는 것으로 판단된다.

6. 결론이 건 심판청구 심리결과 청구인의 주장은 이유 없다고 인정되므로국세기본법 제81조및 제65조 제1항 제2호의 규정에 의하여 주문과 같이 결정한다.
