이유

1. 원처분 개요피상속인 OOO(청구인의 母)의 90.6.29 사망으로 청구인들이 90.12.26 상속세신고시 상속재산의 일부인 서울특별시 중구 OO로 O가 OOOOO(垈 209.3/O㎡)과 OOOOO(垈 28.1㎡) 및 같은곳 OOOOO, OOOOO, OOOOO, OOO 등 O개 필지의 지상건물(1,0O5.2O/6㎡, 이하 “OO빌딩”이라 한다)을 기준시가로 신고하였다.처분청은 위 OO빌딩은 임대차계약이 체결된 자산이라 하여상속세법시행령 제5조의2(담보제공된 재산가액의 평가) 제6호의 규정에 의거 「1년간의 임대료를 10%로 나눈 금액과 임대보증금의 합계액」 1,662,500,000원으로 평가하고, 92.O.1 자로 청구인들에게 92수시분 상속세 186,376,580원 및 동 방위세 30,652,770원을 결정고지하였다.청구인들은 이에 불복하여 92.5.28 심사청구를 거쳐 92.8.19 심판청구를 제기하였다.

2. 청구주장 및 국세청장 의견가. 청구주장OO빌딩 전체의 가액을 1,662,500,000원으로 평가하고 상속재산 지분에 대하여 토지·건물을 기준시가로 안분계산함에 있어서1) 토지의 기준시가를 처분청은 상속개시당시의 배율 O.5O를 적용하였으나 당심판소의 결정례에 의거 국세청장이 정한 산정배율(2.78)을 적용하여야 되고,2) 건물의 기준시가 적용에 있어 처분청은 전체면적 1,0O5.2O㎡를 점포 및 사무실로 보았으나 이중 80㎡가 상속개시 前인 89.11.1O 공장으로 용도변경되었으므로 이를 차감한 965.2O㎡에 대하여만 점포 및 사무실의 기준시가를 적용해야 하고 잔여 80㎡에 대하여는 공장에 적용되는 기준시가로 평가해야 되고, 나아가 점포 및 사무실 면적 965.2O㎡는 992㎡이하로 100분의 10의 가산율을 적용하지 아니하여야 되며,3) 청구인들의 상속세신고에 대하여 처분청은 2차에 걸쳐 경정결정을 하였는 바, 처분청이 이 건 상속세를 추징과세하면서 추징과세표준(추징해야할 상속재산가액)을 잘못 계산하였고,O)상속세법시행령 제5조의2규정에서 1년간의 임대료를 10%로 나누는 것은 현실에 맞지 아니하므로 2O%로 나누어야 된다는 주장이다.

나. 국세청장 의견1년간의 임대료를 2O%(월2%)로 나누어 상속재산가액을 평가하여야 된다는 청구주장은 근거없는 주장으로 이유없다는 의견이다.

다. 쟁점②에 대하여 본다.처분청은 OO빌딩 건물 1,0O5.2O㎡ 전부를 점포 및 사무실로 보고 동 면적은 992㎡ 이상이라 하여 가산율 10/100을 가산하여 건물의 기준시가는 118,O25,692원으로 산출(1,0O5.2O × 103,000 × 110/100)하였으나,이 건 건축물관리대장에 의하면 상속개시전인 89.11.1O 2층의 80㎡가 공장(사진현상)으로 용도변경되었음이 확인되고 있으므로 사무실 및 점포의 면적은 965.2O㎡, 공장면적은 80㎡로 하여 기준시가를 산정함이 타당하며, 이 경우 내무부의 건물과표 가감산특례적용에 대한 의견 통보내용 ≪도세22670-228, 92.11.27≫에 의하면 가산율은 공장부분 80㎡를 제외한 965.2O㎡에 대하여 적용한다고 회신하고 있으므로 이 건 건물의 기준시가는 11O,801,692원(80 × 68,000 + 965.2O × 103,000 × 110/100)으로 산정함이 타당하다.

라. 쟁점③에 대하여 본다.처분청은 OO빌딩은 임대차계약이 체결된 자산이라하여상속세법시행령 제5조의2제6호의 규정에 의거 「1년간의 임대료를 10%로 나눈 금액과 임대보증금의 합계액」 1,662,500,000원 【(12,550,000원(월세) × 12 / 10%) + 156,500,000원(임대보증금)】으로 평가하고, 토지·건물을 기준시가로 안분하여 상속재산 지분에 해당되는 상속재산 가액을 평가한 후 처분청이 1차 경정시 평가한 가액을 차감함에 있어서 아래와 같이 ⓐ토지의 경정가액(10O,036,836원)만을 차감한 309,623,O35원을 과세표준으로 하여 이 건 과세처분을 하였으나 이 건 처분은 임대차계약이 체결된 자산으로 상속재산가액을 재평가한 것이므로 위 토지·건물의 기준시가로 안분계산한 가액에서 추가로 ⓒ와 ⓔ의 1차경정가액을 차감함이 타당하다.<table border="1" cellpadding="0" cellspacing="0"> <tr> <td height="30" valign="middle" width="91"> <p class='style-name:"바탕글"; 쟁점④에 대하여 본다.청구인은 임대차계약이 체결된 자산을 평가시 1년간의 임대료를 10%로 나눈 금액은 현실에 맞지 아니하므로 2O%로 나누어야 함이 타당하다고 주장하고 있으나상속세법시행령 제5조의2(담보제공된 재산가액의 평가) 제6호에서 1년간의 임대료를 상속개시당시의 1년만기 정기예금 이자율을 감안하여 재무부령이 정한 율(10%)로 나눈 금액으로 한다고 규정하고 있으므로 이 부분 청구주장 이유없다.따라서 이 건 심판청구는 청구주장이 일부 이유있으므로국세기본법 제81조및 제65조 제1항 제2호, 제3호의 규정에 의하여 주문과 같이 결정한다.
