8년 이상 자경농지(기각)

1. 원처분 개요청구인은 1988.7.29 대구광역시 동구 OO동 OOOOOO 소재 전 2,559㎡ 및 같은 곳 OOOOOO 소재 전 84㎡ 중 2분지 1지분(이하 “쟁점농지”라 한다)와 같은 곳 OOOOOO 지상 위 주택 40.825㎡, 축사 78㎡, 기타건물 1.57㎡(이하 “쟁점건물”이라 한다)을 취득하여 1997.10.21 양도(원인 : 매매)한 후 쟁점농지는 8년이상 자경농지로, 쟁점건물은 농막으로 하여 자산양도차익예정신고하였다.처분청은 쟁점농지와 쟁점건물을 8년이상 자경한 농지와 농막으로 보지 아니하고 기준시가에 의하여 양도차익을 산정하여 1998.7.15 양도소득세 10,452,900원 결정고지하였다.청구인은 이에 불복하여 1998.7.28 이의신청, 1998.10.23 심사청구를 거쳐 1999.2.18 심판청구를 제기하였다.

2. 청구주장 및 국세청장 의견가. 청구주장청구인은 농지보유기간 중 쟁점농지 소재지외의 타 지역에서 거주한 것으로 주민등록상에 등재되어 있으나, 실제로는 주민등록만 이전하였을 뿐, 쟁점농지 소재지에서 거주하면서 계속 쟁점농지를 자경하였음은 물론, 쟁점건물도 농막으로 사용하였음에도 불구하고 쟁점농지와 쟁점건물을 8년이상 자경한 것으로 보지 아니하고 양도소득세를 과세한 처분은 부당하다.

나. 국세청장의견청구인은 쟁점농지소재지에서 계속 거주하면서 자경하였다는 인우보증서외의 입증자료를 제시하지 못하고 있을 뿐 아니라, 오래 전부터 무직이었다 하나 OO축산(대구광역시 동구 소재)이라는 상호로 양돈축산업을, OO식육점(경상북도 경산시 소재)이라는 상호로 식육소매업 등을 영위한 사실이 있으며, 청구인의 처 명의로 다른 사업장에서 식육소매업을 계속 영위하고 있는 점 등으로 보아 쟁점농지와 쟁점건물은 8년이상 자경한 농지와 농막이라는 청구주장을 인정하지 아니하고 과세한 처분은 정당하다.

3. 심리 및 판단가. 쟁 점쟁점농지와 쟁점건물을 비과세되는 8년이상 자경한 농지와 농막으로 볼 수 있는지의 여부에 있다.

나. 관련법령조세감면규제법 제55조제1항 제1호의 규정에서는「농지소재지에 거주하는 거주자가 8년이상 계속하여 직접 경작한 토지로서 농지세의 과세대상(비과세 감면 및 소액부징수의 대상이 되는 토지를 포함한다)이 되는 토지 중 대통령령이 정하는 토지의 양도로 인하여 발생하는 소득에 대하여는 양도소득세를 면제한다」고 규정하고,같은 법 시행령 제54조 제1항의 규정에서「취득한 때부터 양도할 때까지의 사이에 8년이상 자기가 경작한 사실이 있는 농지.

이 경우 상속받은 농지의 경작기간을 계산함에 있어서는 피상속인이 취득하여 경작한 기간은 상속인이 이를 경작한 기간으로 본다」라고 규정하고,제2항에서 「농지소재지에 거주하는 거주자라 함은 8년이상 다음 각호의 1에 해당하는 지역에 거주하면서 경작한 자를 말한다.

1. 농지가 소재하는 시·군·구안의 지역2. 제1호의 지역과 연접한 시·군·구안의 지역」이라고 규정하고 있다.

다. 사실관계 및 판단청구인은 쟁점농지와 쟁점건물을 1988.7.29 취득하여 1997.10.21 양도하였으므로 8년이상 보유(약 9년 3개월)하였음이 등기부등본에 의하여 확인되고, 청구인이 쟁점농지와 쟁점건물 취득일 이후인 1990.5.30부터 1992.8.27까지의 기간동안(약 2년 2개월)은 쟁점농지소재지 또는 그 연접지역이 아닌 지역인 경기도 광명시 OO동 OOOOOOOOO, 서울특별시 구로구 OO동 OOOOOOOO 등에서 거주한 것으로 주민등록초본에 의하여 확인되고, 그에 따른 쟁점농지소재지 거주기간이 8년 미만(7년 1개월)인 사실에 대하여는 청구인과 처분청간에 다툼이 없다.청구인은 오래 전부터 무직이었던 관계로 그의 처와 가정불화로 별거하여 왔고, 또한 그의 처 및 자녀는 학교교육문제 등으로 경기도 광명시, 서울특별시 구로구 등의 지역으로 이주하였으나, 청구인의 주민등록상으로만 동 지역에 거주한 것으로 하였을 뿐, 실제로는 쟁점농지소재지에 계속 거주하면서 대추나무농사를 경작하였음을 주장하면서, 동 지역으로 이전된 기간(1990년～1992년)동안의 농약구입확인서 및 고용확인서, 쟁점농지의 인근주민 OOO외 4인의 인우보증서, 거주사실확인서, 청구인의 자 OOO의 생활기록부 및 학생이동원부 등의 입증자료를 제시하고 있으나, 청구인의 자인 OOO의 생활기록부(1987.3.5 대구 OO초등학교 입학, 1993.2.18 대구 OO초등학교 졸업) 및 학생이동원부(대구 OO초등학교장 확인)에서 청구인의 직업이 상업이었고, 그의 전 가족이 이주(서울특별시 OO동)한 것으로 기재되어 있는 점으로 보아 청구인이 주민등록만 이주된 것일 뿐 실제로는 쟁점농지소재지에 거주하면서 자경하였다는 주장은 신빙성 있다고 보기 어려울 뿐만 아니라, 청구인과 그의 처가 각자 명의의 사업장 영위(청구인은 서울특별시 등의 지역으로 이주된 기간을 포함하여 1995.12.31까지, 그의 처는 현재까지)사실이 국세청의 국세통합시스템(TIS) 조회결과, 아래표와 같이 확인되고 있는 점 등을 종합하여 볼 때,<table border="1" cellpadding="0" cellspacing="0"> <tr> <td height="47" valign="middle" width="312"> <p class='style-name:"바탕글"; 라. 따라서 이 건 심판청구는 청구주장이 이유없으므로국세기본법 제81조및 제65조 제1항 제2호의 규정에 의하여 주문과 같이 결정한다.
