2. 청구주장 및 국세청장 의견가. 청구주장처분청에서는 청구인이 운영하던 터키탕의 매출누락분에 대한 부가가치세를 과세하면서 고객이 입장할 때 미리 징수하여 납부하게 되어 있는 특별소비세 및 교육세 상당액(508,326,760원)도 과세표준에 포함시켜 과세하였는바, 청구인이 이용고객들로부터 받은 특별소비세 및 교육세의 경우 부가가치세법상 과세표준인 “代價”에 해당하지 아니한다 할 것이므로 특별소비세 및 교육세 상당액은 과세표준에서 제외하여 부가가치세를 과세하여야 한다.

나. 국세청장 의견부가가치세 과세표준에는 거래상대방으로부터 받는 대금·요금·수수료·기타 명목여하에 불구하고 실질적 대가관계 있는 것으로서 모든 금전적 가치가 있는 것이 포함되어 특별소비세가 과세되는 재화 또는 용역의 경우도 당해 특별소비세 및 주세와 교육세 상당액은 부가가치세 과세표준에 포함된다 할 것이므로 처분청에서 청구인이 터키탕 이용자들로부터 받은 특별소비세등을 과세표준에 포함시켜 부가가치세를 과세한 이 건 처분은 달리 잘못이 없다.

3. 심리 및 판단가. 쟁점이 건 심판청구는 청구인이 터키탕 이용자들로부터 받은 특별소비세 및 교육세상당액을 과세표준에 포함시켜 부가가치세를 과세한 처분의 당부에 그 다툼이 있다.

나. 관련법령특별소비세법 제1조제3항 본문에서 「입장행위(관련 설비 또는 용품의 이용을 포함한다. 이하 같다)에 대하여 특별소비세를 부과할 장소(이하 “과세장소”라 한다)와 그 세율은 다음과 같다」고 규정하면서,그 제3호에서 「터키식탕 1인 1회 입장에 대하여 1만원(1994.12.22 개정)」을 열거하고 있으며,부가가치세법 제13조제1항 본문에서 「제화 또는 용역의 공급에 대한 부가가치세의 과세표준은 다음 각호의 가액의 합계액(이하 “공급가액”이라 한다)으로 한다.

다만, 부가가치세는 포함하지 아니한다」고 규정하면서그 제1호에서 「금전으로 대가를 받는 경우에는 그 대가」를 열거하고 있고,같은법 시행령 제48조제1항에서는 「법 제13조 제1항에 규정하는 과세표준에는 거래상대자로부터 받은 대금·요금·수수료 기타 명목여하에 불구하고 대가관계에 있는 모든 금전적 가치 있는 것을 포함한다」고 규정하고 있다.

다. 사실 및 판단청구인이 운영하던 사업장(터키탕)에서 1994년 1기 160,678,457원, 1994년 2기 217,736,383원, 1995년 1기 293,327,272원, 1995년 2기 373,264,636원, 1996년 1기 401,940,909원, 1996년 2기 189,319,450원의 수입금액이 누락된 사실에 대하여는 청구인과 처분청간에 다툼이 없다.처분청에서는 청구인이 터키탕이용자들로부터 받은 특별소비세 및 교육세 상당액(508,326,760원)을 부가가치세 과세표준에 포함하여 부가가치세를 과세하였고 이에 청구인은 청구인이 터키탕 이용자들로부터 받은 특별소비세 및 교육세 상당액은 부가가치세법상 과세표준인 “代價”에 해당하지 아니하므로 특별소비세 및 교육세 상당액까지 과세표준에 포함시켜 부가가치세를 과세한 것은 부당하다고 주장하고 있는 바, 이에 대해 살펴보면,부가가치세의 과세표준에는 거래상대자로부터 받은 대금·요금·수수료 기타 명목여하에 불구하고 대가관계에 있는 모든 금전적 가치 있는 것을 포함하도록 앞에서 살펴본부가가치세법 시행령 제48조제1항에서 규정하고 있는 바, 특별소비세 및 교육세가 과세되는 재화 또는 용역은 특별소비세 및 교육세가 포함된 공급가액으로 제공되는 것이므로 거래상대자로부터 받은 당해특별소비세 및 교육세 상당액을 부가가치세 과세표준에 포함하는 것이 입법취지에 부합된다 할 것이고, 따라서 처분청에서 청구인이 터키탕이용자들로부터 받은 특별소비세 및 교육세 상당액을 과세표준에 포함시켜 부가가치세를 과세한 처분은 달리 잘못이 없다고 판단된다.

라. 결론이 건 심판청구는 심리결과 청구주장이 이유없다고 인정되므로국세기본법 제81조및 제65조 제1항 제2호의 규정에 의하여 주문과 같이 결정한다.
