제출한 농지원부에 의하면 청구인이 쟁점농지 소재지에 여타 2필지 전을 직접 경작하고 있는 것으로 나타나는 바, 처분청이 청구인의 실지 경작여부 등을 재조사하여 양도소득세의 과세표준 및 세액을 경정함이 정당함

○리 96 전 806㎡, 같은 리 97 전 2,089㎡(합계 전 2,895㎡,이하 “쟁점농지”라 한다)를 2008.4.29. 양도하고, 2008.5.30. 양도소득세 신고시 「조세특례제한법」 제69조 의 규정에 의한 8년 이상 자경농지에 대한 양도소득세 감면신청을 하였다. 나.

○지방국세청장은 처분청에 대한 업무감사시, 청구인이 “

○

○비료”를 운영하는 사업자인 점 등에 따라 청구인의 감면신청을 배제하고 양도소득세를 과세하도록 지적하자 처분청은 쟁점농지를 청구인이 직접 경작하지 아니한 비사업용 토지로 보아 중과세율을 적용하여 2009.6.8.청구인에게 2008년 귀속 양도소득세 238,200,740원을 경정·고지하였다.

다. 청구인은 이에 불복하여 2009.8.25. 심판청구를 제기하였다.

2. 청구인 주장 및 처분청 의견 가. 청구인 주장 청구인이 운영하는 “

○비료”는 2007년 연간 소득금액을 보면 21백만원으로 월별 환산시 1,800천원 정도인 소규모 영세사업체이고, 비료판매량의 90%정도가 11월부터 4월사이에 집중되고 나머지 10%가 5월부터 9월에 판매되는 바, 청구인은 쟁점농지에서 매년 5월에 파종하고 9월에 수확하는 고추,고구마,깨 등을 재배하였고 청구인의 경작사실은 영농회장 등이 작성한 확인서에 의하여도 확인된다.

나. 처분청 의견 자경한 사실에 대하여는 청구인이 이를 입증하여야 하는 바(대법원92누11893,1993.7.13.), 청구인은 쟁점농지 취득당시부터 현재까지 “

○

○비료”등을 운영하는 사업자로서 2006년 연간 수입금액이 726백만원으로 그 업무에 전적으로 종사하였다고 보는 것이 일반적이다. 청구인은 쟁점농지를 포함한 농지 규모가 11,669㎡로 농기계에 의한 농작업이 필수적이고, 이러한 농기계는 고가의 장비이고 조작이 용이치 않아 거의 빌려주지 않은 실정이어서 대부분의 경우 작업내용 및 면적에 따라 대금을 지불하는 것이 통상적인 바, 이러할 경우 「조세특례제한법 시행령」제66조 제13항이 신설된 이후 양도분인 쟁점농지의 양도의 경우에는 자기의 노동력에 의한 경작이라고 볼 수 없다.

밭농사는 로터리 작업이 약 30%이고 나머지는 수작업으로 대부분 타인의노동력에 의존하며, 청구인이 이러한 농기계도 없고, 다른 직업에 종사하면서 자기노동력을 1/2이상 투입하기 어려운 점 등을 볼 때 쟁점농지를 청구인이 직접 경작하였다고 볼 수 없으므로 과세처분은 정당하다.

3. 심리 및 판단 가. 쟁점 청구인이 쟁점농지를 8년 이상 자경하였는지 여부 나. 관련법령 (1) 조세특례제한법 제69조 【자경농지에 대한 양도소득세의 감면】① 농지 소재지에 거주하는 대통령령으로 정하는 거주자가 8년 이상[대통령령으로 정하는 경영이양 직접지불보조금의 지급대상이 되는 농지를 「한국농어촌공사 및 농지관리기금법」에 따른 한국농어촌공사 또는 농업을 주업으로 하는 법인으로서 대통령령으로 정하는 법인(이하 이 조에서 농업법인 이라 한다)에 2010년 12월 31일까지 양도하는 경우에는 3년 이상] 직접 경작한 토지로서 농업소득세 과세대상[비과세·감면 및 소액부징수(소액불징수) 대상을 포함한다]이 되는 토지 중 대통령령으로 정하는 토지의 양도로 인하여 발생하는 소득에 대해서는 양도소득세의 100분의 100에 상당하는 세액을 감면한다.

다만, 해당 토지가 「국토의 계획 및 이용에 관한 법률」에 따른 주거지역·상업지역 및 공업지역(이하 이 조에서 주거지역등 이라 한다)에 편입되거나 「도시개발법」 또는 그 밖의 법률에 따라 환지처분(환지처분) 전에 농지 외의 토지로 환지예정지 지정을 받은 경우에는 주거지역등에 편입되거나, 환지예정지 지정을 받은 날까지 발생한 소득으로서 대통령령으로 정하는 소득에 대해서만 양도소득세의 100분의 100에 상당하는 세액을 감면한다.

(2) 조세특례제한법 시행령 제66조 【자경농지에 대한 양도소득세의 감면】① 법 제69조제1항 본문에서 농지소재지에 거주하는 대통령령으로 정하는 거주자 란 8년[제3항의 규정에 의한 경영이양보조금의 지급대상이 되는 농지를 「한국농어촌공사 및 농지관리기금법」에 따른 한국농어촌공사(이하 이 조에서 한국농어촌공사 라 한다) 또는 제2항의 규정에 따른 법인에게 양도하는 경우에는 3년] 이상 다음 각 호의 어느 하나에 해당하는 지역(경작개시 당시에는 당해 지역에 해당하였으나 행정구역의 개편 등으로 이에 해당하지 아니하게 된 지역을 포함한다)에 거주하면서 경작한 자를 말한다.

(3) 소득세법 제104조 의3 【비사업용 토지의 범위】① 제96조제2항제8호 및 제104조제1항제8호에서 비사업용 토지 란 해당 토지를 소유하는 기간 중 대통령령으로 정하는 기간 동안 다음 각 호의 어느 하나에 해당하는 토지를 말한다.

1. 논·밭 및 과수원(이하 이 조에서 농지 라 한다)으로서 다음 각 목의 어느 하나에 해당하는 것 가. 대통령령으로 정하는 바에 따라 소유자가 농지 소재지에 거주하지 아니하거나 자기가 경작하지 아니하는 농지. 다만, 「농지법」이나 그 밖의 법률에 따라 소유할 수 있는 농지로서 대통령령으로 정하는 경우는 제외한다.

다. 사실관계 및 판단 (1) 쟁점농지 등기부등본, 청구인의 주민등록초본·농지원부, 처분청의 양도소득세 경정결의서 등의 심리자료에 의하면 다음의 사실이 확인된다. (가) 쟁점농지는 그 지목이 전인 농지로서 청구인은 이 중

○도 1997년 전입하여 함께 거주하고 있는 바, 청구인의 주소지 및 사업장에서 쟁점농지까지는 차량으로 약 18분정도 소요(차량거리 : 7.05Km, 7.57Km)되는 것으로 나타난다. (다) 「조세특례제한법」제69조 의 규정에 의한 8년 이상 자경농지에 대한 양도소득세 감면요건 중 청구인이 쟁점농지를 직접 경작하였는지 여부를 제외한 여타 요건은 모두 충족하고 있으며, 처분청은 청구인이 쟁점농지를 직접 경자하지 아니한 것으로 보아 이 건 과세처분하였다.

(2) 처분청이 제출한 청구인 사업내역, 수입금액 등의 심리자료에 의하면 다음의 사실이 나타난다. (가) 청구인의 사업내역은 아래 <표1>과 같아서, 청구인은 쟁점농지를 양도할 당시

○비료”를 운영하게 되었는데, 동 비료의 매출은 시비를 일찍 하여야 하는 관계로 농사철 전에 주로 발생하고, 2005년 이후로는 아들인

○가 동사업에 적극적으로 참여하면서 본인은 영업하는데 지원하는 일 정도를 하고 있다는 취지의 진술을 하면서 제출한 청구인의 자(子)

○(780309-*******)에 대한 근로소득원천징수영수증에 의하면

○

○는 2005.3.2.부터 현재까지 연 급여 16,800,000원을 받으면서 “

○

○비료”에서 일하고 있는 것으로 나타나며, 이 건 양도소득세 과세경위와 관련하여

○

○지방국세청장이 실시한 감사에 따른 과세로서 처분청이 청구인의 직접 경작사살을 실지조사한 사실은 없었다고 진술하였다.

(5) 이상의 관련 사실관계를 종합하여 보면, 토지가 농지로 경작된 사실이 인정된다고 하더라도 그렇다고 하여 그 소유자가 자경한 사실까지 추정되는 것은 아니고, 토지를 농지로 자경한 사실은 그와 같은 사실을 주장하는 양도자가 입증하여야 할 것인 바(대법원 92누11893,1993.73.13. 등 다수) (가) 청구인은 쟁점농지 인근에서 21년이상 거주하였고, 청구인이 쟁점농지를 직접 경작하였음을 쟁점농지 소재지 주민이 확인하였으며, 관련 농자재를 구입하였음이 농협의 매출내역이나 인근 종묘농약사의 확인서나 영수증에 의하여 확인되고, 수확한 작물을 판매한 것도

○농협으로부터 대출을 받아 트랙터를 구입하였다가 현재는 이를 폐기하였는 바, 청구인이 전혀 경작을 하지 아니하였음에도 당시 이를 구입하였을 가능성은 적은 것으로 보이고, 그 이후에는 인근 주민이나 농협으로부터 충분히 농기계를 임대할 수 있을 뿐 아니라 청구인이 제출한 동영상자료 등에 의하면 청구인이 충분히 트랙터 등 농기계를 능숙하게 조작할 수 있는 것으로 보이며, 여타 고추건조기 등 농업에 필요한 각종 농자재를 보유하고 있었으므로 처분청에서 청구인이 아닌 타인이 쟁점농지를 경작하였다는 증빙 등을 달리 제출하지 아니하고 있는 사실에 비추어 별다른 반증이 없는 한 청구인이 쟁점농지를 직접 경작한 것으로 보는 것이 타당한 것으로 판단된다.

(나) 그러나, 처분청이 제출한 사업내역상 청구인은 주소지 인근에서 1998.4.21.부터 유기질비료제조업을 영위하고 있고, 지난 10년간 연평균 매출액이 480백만원 달하는 것으로 나타나고 있는 바, 비록 청구인의 소명내용과 같이 영위한 업종이 농업과 밀접한 관련성이 있는 유기질비료 제조업으로서 업종의 특성상 매출이 농사철이 아닌 겨울과 초봄에 주로 발생하고 동 사업을 2005년 이후에는 자(子)

○가 도왔다고 하더라도, 이러한 정도의 외형을 가진 사업체를 운영하는 청구인이 쟁점농지에서 농작물의 경작 또는 다년성(多年性) 식물의 재배에 상시 종사하거나 농작업의 2분의 1이상을 자기의 노동력에 의하여 경작 또는 재배하였다고 섣불리 단정하기 어려운 측면이 있다. (다)한편, 청구인의 주장 및 진술내용과 처분청이 제출한 심리자료에 의하여 나타나는 이 건 과세처분은

○지방국세청장의 감사지적에 의한 과세로서 처분청이 청구인의 경작여부를 실지 확인한 사실이 나타나지 않을 뿐만 아니라, 청구인이 제출한 농지원부에 의하면 청구인이 쟁점농지 소재지인
