2. 청구주장 및 국세청장 의견가. 청구주장쟁점주택이 단독주택으로 건축허가를 받아 신축되었으나 실제에 있어 각 층내 1세대 또는 2세대가 독립하여 거주할 수 있도록 세대별로 방, 부엌, 거실 및 화장실등을 구비하였음은 물론 출입구도 각각 설치하여 주택당 4세대 내지 6세대가 독립적으로 생활할 수 있는 다가구주택으로 건축되었고, 1세대당 주거전용 면적 역시 국민주택 규모(85㎡)이하이므로 이 건 부가가치세는 취소되어야 한다는 주장이다.

나. 국세청장 의견쟁점주택이 공부상 단독주택으로 등재되어 있음에도 청구인은 쟁점주택이 공동주택의 요건을 구비하였는지 여부를 확인할 수 었는 설계도면등의 증빙을 전혀 제시 못하고 있을 뿐만 아니라, 공동주택인 다가구용 단독 주택의 경우 일반적으로 1동의 주택을 각 세대별로 구분하여 별도로 양도하고 있음에도 불구하고 쟁점주택은 이와달리 1동의 주택 전체를 1인에게 양도하였고, 또한 쟁점주택은 “다가구용 단독주택의 건축기준”이 시행(90.2.28)되기 전에 준공된 건축물이므로 당초 처분은 달리 잘못이 없다는 의견이다.

3. 심리 및 판단가. 이 건의 쟁점은 쟁점주택이 주택건설촉진법상 국민주택에 해당되는지 여부를 가리는데 있다.

나. 관련법규정을 보면조세감면규제법 제74조제1항 제1호의 규정에 의하면 국민주택을 건설·공급하는 경우 부가가치세를 면제하도록 규정되어 있고,주택건설촉진법 시행령 제30조제1항 단서규정에서 국민주택의 경우 주택의 단위규모는 1호 또는 1세대당 85㎡ 이하로 한다고 규정되어 있으며,같은법 시행규칙 제17조제1항에서 주택의 단위 규모는 호당 또는 세대당 주거전용면적을 뜻하는 것으로 규정되어 있다.

다. 쟁점주택이 공동주택에 해당되는지 여부(1)주택건설촉진법 제3조제2호는 주택을 단독주택과 공동주택으로 구분하고, 같은조 제3호에서는 공동주택이라 함은 대지 및 건물의 벽, 복도, 계단 기타 설비등의 전부 또는 일부를 공동으로 사용하는 각 세대가 하나의 건축물 안에서 각각 독립된 주거생활을 영위할 수 있는 구조로 된 주택을 말하며,같은법 시행령 제2조는 법 제3조 제3호의 규정에 의한 공동주택의 종류와 범위는 아파트(5층이상의 주택), 연립주택(동당 건축 연면적이 660㎡를 초과하는 4층이하의 주택), 다세대주택(동당 건축 연면적이 660㎡이하인 4층이하의 주택)이라고 규정되어 있다.따라서 대지 및 건물의 벽, 복도, 계단 기타 설비등의 전부 또는 일부를 공동으로 사용하는 각세대가 하나의 건축물 안에서 각각 독립된 주거생활을 영위할 수 있는 구조로 된 주택이 공동주택이고, 그렇지 아니한 주택은 단독주택인 것으로 해석되어야 할 것이다.

(2) 일반적으로 공동주택인 다세대주택의 건축조건은 단독주택을 건축하는 경우에 비하여 엄격한 건축허가 기준이 적용되고 있었기 때문에 다세대주택의 건축허가를 얻기 어려운 형편에 있는 건축주들이 편법으로 단독주택의 건축허가를 얻어 사실상 공동주택인 다세대주택과 같은 구조 및 용도의 건물을 건축하는 건축법령 위반사례가 많아짐에 따라 90.2.28 정부에서는 세입자의 주거안정보호와 주택보급율 제고등의 목적을 위하여 「다가구용 단독주택의 건축기준」이라는 행정지침을 시달하여 위와 같은 형태의 주택에 대한 일정한 기준을 설정하는 한편 동 주택은 가구별로 임대만이 가능하고 분양이나 구분소유는 불가능 하도록 하였으며, 90.3월 이후부터는 건축허가와 준공 후의 건축물 관리대장등에는 「다가구용 단독주택」임을 명기하도록 한 사실이 건설부의 다가구용 단독주택의 건축기준시달 공문(건축 30420-4535, 90.2.28)등에 의하여 확인되고 있다.

(3) 쟁점주택의 건축물관리대장 및 등기부등본을 보면, 쟁점주택은 88.11.2 내지 89.7.11 사이에 신축된 건축물로서 그 용도가 주택으로만 표시되어 있으나 당심 담당공무원의 현장확인(95.5.24) 및 현장사진, 간이설계도면등에 의하면 설계 및 건축단계에서부터 위 1. 사실에서 보는 바와 같이 4세대 내지 6세대가 살 수 있도록 물리적으로 동별 지하층, 1층 및 2층으로 구획되어 있고, 각세대 단위마다 독립하여 방실과 생활시설이 설치되어 있어서 각각 독립된 주거생활을 영위할 수 있도록 되어 있으며, 대지, 벽, 계단, 복도 기타 설비등을 각세대가 공동으로 사용하도록 되어 있으므로 그 실질에 비추어 이를 다세대주택인 공동주택으로 보지 아니할 수 없으며, 당심이 OOO동장과 OOO동장에게 쟁점주택에 현재(95.5.25기준) 주민등록이 되어 있는 모든 세대주의 주민등록등본을 요구하였던 바 쟁점주택 각 동마다 4세대 내지 7세대의 주민등록이 되어 있는 사실등을 볼 때 역시 위에 설시한 내용을 미루어 짐작할 수 있고, 또한 세대별 분양불가 조건의 단독주택으로 주택허가를 받아 건축물 관리대장 또는 등기부에 단독주택으로 등재되어 있는 주택의 경우도 그 구조 및 용도가 공동주택에 해당된다면 공동주택으로 보는 것이 실질과세의 원칙과 과세형편상 타당하다 하겠다(대법원 93누7075, 93.8.24 같은 뜻임)(4) 다가구용 단독주택인 쟁점주택을 공동주택으로 볼 경우 그 세대별 규모가 부가가치세 면제대상인 국민주택에 해당되는지를 보면 쟁점주택의 세대별 면적은 66.16㎡이하로서 이는 국민주택 규모인 85㎡ 이하에 해당된다.위의 사실을 종합하여 볼 때, 청구인이 신축판매한 쟁점주택은조세감면규제법 제74조제1항 제1호의 규정에 의하여 부가가치세가 면제되는 국민주택의 공급에 해당된다고 볼 수 있으므로 쟁점주택의 신축판매를 단독주택의 양도로 본 처분청의 이 건 처분은 관련법리를 오해한 것으로 판단된다.

라. 따라서 이 건 심판청구는 청구주장 이유있으므로국세기본법 제81조및 제65조 제1항 제3호의 규정에 의하여 주문과 같이 결정한다.
