심판청구가 적법한지 여부(각하)

이 건은 처분청이 청구인등에게 1994.8.1자로 결정고지한 1992년도분 상속세 313,250,700원의 부과처분에 대하여 청구인등이 1994.10.21, 1995.6.15 심사청구 및 심판청구를 제기하여 청구기간 경과로 각하결정을 받고 1995.8.14 행정소송을 제기하였다가 소취하 한 후 피상속인 OOO 명의의 OO농협 납입 출자금 반환금 2,823,480원, OO생명 보험주식회사 생명보험금 7,500,980원 합계 10,324,460원이 상속재산에서 누락되었으므로 이를 포함하여 경정 고지해 줄 것을 청구인등이 1995.12.30자로 처분청에 시정요구하였으나 처분청이 동시정요구에 대하여 증액 결정을 하지 않는 것은 부당하다며 불복한 건이다.국세기본법 제55조제1항에서 “이 법 또는 세법에 의한 처분으로서 위법 또는 부당한 처분을 받거나 필요한 처분을 받지 못함으로써 권리 또는 이익의 침해를 당한 자는 이 장의 규정에 의한 심사청구를 하여 그 처분의 취소 또는 변경이나 필요한 처분을 청구할 수 있다.
